John Foust is a seasoned construction lawyer with 18 years of experience litigating and advising clients on complex construction matters in the United States and abroad.
Claims and Disputes. John represents owners and contractors in the prosecution and defense of all manner of contract disputes, including schedule claims, payment claims, change-order and extra-work claims, as well as defective-work claims and post-completion warranty claims. He has litigated construction cases in state court, federal court, and before arbitration tribunals in California, Nevada, Minnesota, New Mexico, New York, Hong Kong, and Dubai.
Construction Contract Drafting and Review. John drafts and negotiates contracts for construction projects, including construction contracts, architecture and engineering agreements, material purchase agreements, guarantees, master development agreements, joint venture agreements, and others.
Project Counseling. John frequently acts as project counsel for ongoing developments by providing day-to-day advice on issues such as change orders, time extensions, risk management issues, and contractor terminations.
John frequently writes and lectures on construction law issues and is actively involved in the ABA Forum on Construction law, where he is the Editor-in-Chief of the preeminent construction-law journal, The Construction Lawyer, and the immediate past-chair of the International Construction Division. He has been recognized as a leading construction lawyer by SuperLawyers, Legal 500, the International Who’s Who of Construction Lawyers, and Chambers USA.
Prior to joining Ralls Gruber & Niece LLP, John was a partner at the law firms of Jones Day and Howrey LLP and an associate at Thelen LLP. Before entering private practice, John completed a federal clerkship with Judge Edward F. Herrington of the U.S. District Court for the District of Massachusetts.
